Penalties for a Second DUI Offense

If you are arrested for your second DUI offense within 60 months of your first DUI offense in Arizona, you will face enhanced legal penalties. In fact, you may be sentenced to mandatory jail time.

The penalties for a second DUI conviction may include:

  • Mandatory minimum of 30 days in jail
  • Maximum of six months in county jail
  • Up to $3,000 in various fines and fees
  • One-year revocation of your driver's license
  • Installation of an ignition interlock device

Penalties for a Third DUI Offense

If you are arrested for a third DUI offense in Arizona, you will automatically be charged with a felony. This means that you can expect to face stiff legal penalties if you are eventually convicted.

The penalties for a third DUI conviction may include:

  • Minimum of four months in jail
  • Maximum of two and a half years in jail
  • At least $4,000 in various fines and fees
  • Three-year revocation of your driver's license
  • Installation of an ignition interlock device

Multiple Extreme DUI or Super Extreme DUI Convictions

The penalties listed above are for DUI offenses that did not rise to the level of an “extreme DUI” or “super extreme DUI.” The difference between a standard DUI and an extreme or super extreme DUI comes down to your blood alcohol concentration (BAC). If your BAC was measured at 0.15%, you would be charged with extreme DUI. If your BAC exceeded 0.20%, you would be charged with super extreme DUI. The penalties for multiple convictions under these circumstances are more severe.

The penalties for a second extreme DUI include:

  • Minimum of 120 days in county jail
  • At least $3,000 in various fines and fees
  • One-year revocation of your driver’s license
  • Installation of an ignition interlock device

The penalties for a second super extreme DUI include:

  • Minimum of 180 days in county jail
  • At least $17,000 in various fines and fees
  • One-year revocation of your driver’s license
  • Installation of an ignition interlock device
