Arizona DUI Penalties

The consequences you face for DUI will depend on several things, such as whether it was your first offense, your blood alcohol content, whether there was a drunk driving accident or whether there was a child in the vehicle.

Penalties for a 1st DUI Conviction

  • Up to six months in county jail (10 days minimum)
  • Fines and court fees reaching $2,500 or more
  • Driver's license suspension for up to 90 days

  • Potential term of probation for up to five years

Penalties also vary depending on the type of DUI charge in Arizona:

  • Standard DUI: Driving a vehicle with either a blood alcohol content (BAC) of .08 percent or more, .04 percent or more if driving a commercial truck, or any percentage if the driver is under 21 years old.

The penalties for a first Standard DUI may include:

  • Up to 10 days in jail
  • Up to $1,500 in fines
  • 90-day suspension or one year revocation
  • Use of an ignition interlock device for 12 months

Extreme DUI: Driving a vehicle with a BAC of .15 percent or more. If your BAC is .20% or greater, you will likely face charges for super extreme DUI—which will result in much harsher penalties.

The penalties for a first extreme DUI conviction may include:

  • Up to six months in county jail (30 days minimum)
  • Fines and court fees reaching $2,500 or more
  • Driver’s license suspension for up to 90 days

  • Use of an ignition interlock device for at least 12 months
  • Potential term of probation for up to five years

The penalties for a first super extreme DUI conviction may include:

  • Up to six months in county jail (45 days minimum)
  • Fines and court fees reaching $3,000 or more
  • Driver’s license suspension for up to 90 days
  • Substance abuse counseling & community service
  • Use of an ignition interlock device for at least 12 months
  • Potential term of probation for up to five years

Aggravated DUI: Either accruing a third DUI offense within 84 months, driving a passenger younger than 15 years old while under the influence, or receiving a DUI with a suspended, revoked, or canceled driver’s license.

  • The penalties for a first Aggravated DUI may include:
    • Between 4 months and up to 3.75 years in prison
    • Fines of at least $4,700
    • Driver's license suspension for 3 years
    • Use of an ignition interlock device for 2 years

Arizona laws are not lenient toward drivers convicted of DUI. A person who commits DUI will not only have to face penalties with the Arizona Motor Vehicle Division, but also will face criminal charges.

Are DUI Breath Tests Accurate?

Breath tests can be performed on the road during a traffic stop or at a police station after an arrest. The breathalyzer involves blowing into a machine that analyzes how much alcohol is contained in your breath. This is a very indirect method of determining BAC, as the results are not based on how much alcohol is actually in the body. Depending on body temperature and respiration rate, the results of the test can easily be skewed.

Additionally, there are a number of other factors that could throw off the results of a breath test. Certain mouthwashes, breath fresheners, and toothache medicines, or any other substance containing alcohol, could cause an inaccurate reading. Even a burp or regurgitation of stomach acid just prior to or during the test can skew results.

This is not to mention the problem of maintenance. Breathalyzer machines must be routinely maintained and calibrated to keep them accurate, but many times they are not. If a breath testing machine malfunctions, it could result in a false-positive reading, and as a consequence, you could face penalties that you may not even deserve.
